А кто писал вводную? Существует два вида лобби по данному вопросу, как я понимаю, это фармацевтические корпорации, прежде всего (и у них должно быть сильнейшее лобби на всех уровнях, от Конгресса, до откатов врачам в экс-СССР), и во-вторых, с/х корпомонстры типа Cargill, Tyson Foods, Monsanto. Тема, конечно, трудноотделима от темы ГМО, лекарств и применения удобрений/анаболиков в с/х. Кто бы распутал этот клубок. --[[Участник:Phantom|Phantom]] 18:24, 4 декабря 2007 (UTC)

::: Законы просто так ниоткуда не берутся. Как говорит Жирик, сначала в правительство въезжают чемоданы (с деньгами), потом решаются все вопросы. РФ не проводит независимой политики в отношении фармации. ТНК насилуют всех, начиная от Конгресса США и кончая ''российскими'' журналами "Здоровье" и пр. Скорее всего, селекционные законы РФ принимаются под давлением запада (детально пока не изучал, ст. 13 и 8 раздел закона об этом конкретно свидетельствуют). Может до с/х корпорации ещё не добрались (надежды юношей питают), но в таком случае это дело будущего. В США потребовалось пару десятков лет, чтобы выдавить мелких фермеров с с/х рынка. А вот [http://194.226.82.76/government/governmentactivity/rfgovernmentdecisions/archive/2007/10/08/765803.htm# тот] список как раз выглядит как жалкая попытка кого-то в правительстве помахать кулаками после драки. Закон и часть ГК о селекции, в принципе, открывает путь западных корпораций на с/х рынок России. Приходится признать, я написал херню. Копирайта на гены пока нет, по крайней мере я такого не нашел. В основном применяются патенты и специальный вид исключительных прав. "В 2006 году принята 4-я часть Гражданского Кодекса РФ, который вступит в силу в 2008 году. Среди многих идиотских и вредительских норм этого закона он распространяет авторское право на селекционных животных и растения. Ещё до вступления закона в силу даже правительству РФ стало очевидно, что внедрение этого пункта грозит окончательным уничтожением сельского хозяйства. В спешном порядке указом правительства было введено понятие национальное достояние – аналог общественного достояния для растений. Это растения, которые можно сажать безнаказанно. На выращивание всех остальных овощей и фруктов необходимо получать разрешение правообладателей."

Аффтару -- почитать действующий сейчас закон "О селекционных достижениях". Все описанное там уже есть, ничего не "введено". И про "национальное достояние" тоже херня написана, его нельзя "сажать безнаказанно".

Здравствуйте, спасибо за информативный отзыв, если бы вы ещё и зарегились, то было бы совсем удобно беседовать.
Про закон я не знал, спасибо что указали. Только вот в чем дело, колхозники никому отчислений за продажу семян не платят и если услышат про такой побор, то могут осерчать. Видимо это один из пустых ельцинских законов, которые никогда не применяли и по факту были отменены.
